All potential bidders that rely on the financial standing of a guarantor may use the standard Form of Guaranty appended to the Default Service Supply Master Agreement (“Default Service SMA”).
The Guaranty Process is an opportunity for potential bidders to:
- Submit an alternate guaranty form for consideration by PECO; or
- Propose modifications to the standard Form of Guaranty that are non-material in nature or advantageous to both PECO and the potential bidder.
PECO has specified a list of minimum requirements that any alternate guaranty form must satisfy, including the requirement that the alternate guaranty form must not be subject to a monetary limit. These requirements are listed in the Guaranty Process document, posted to the Supplier Information – Documents page.
The deadline to submit an alternate guaranty form is 6PM EPT on Thursday, December 12, 2013. Potential bidders that choose to submit an alternate guaranty form must submit all required materials electronically by email to the Independent Evaluator at pecoprocurement@nera.com.
The deadline to propose modifications to the standard Form of Guaranty is 6PM EPT on Thursday, December 12, 2013. Potential bidders that choose to propose modifications to the Form of Guaranty must do so by submitting a Microsoft Word document using substantially the Form of Guaranty and indicating clearly any and all modifications to the Form of Guaranty. Materials must be submitted electronically by email to the Independent Evaluator at pecoprocurement@nera.com.
